4-0 out of 5 stars making women pay...an eye opener.
Rachel Roth sheds intellectual and logical light on some highly emotional issues. Her book covers topics such as women's employment, citizenship, and individual rights. This book does not ponder the moral question of abortion, but rather it points out the price women must pay and the burdon they bear during pregnacy.Women no loger have control over their bodies and in some cases are forced into unwanted medical procedures. This book should be read by all because it well documented and shows how society puts more importance on the fetus and less on the woman. However, I sometimes found this book to get a little repetative in the message it was conveying. ... Editorial Review

For coauthors Linda Hirshman and Jane Larson, sex is a matter of political negotiation. Focusing on heterosexual practice in four specific forms--rape, fornication, adultery, and prostitution--they trace the history and law of sexual regulation in the West from the ancients to the present day. In the final section, they lay out their "prescription for a new sexual order," proposing "that the touchstone for political legitimacy requires the recognition that women are political players, that adult heterosexuality is a political relationship, and that the goal of sexual politics is neither to be the handmaid of an antique morality nor the umpire in a free-for-all between unequal players."Read more

2-0 out of 5 stars Over-reliant on a trendy but sterile methodology
Hirshman and Larson, law professors at Brandeis and the University of Wisconsin, see a remarkable transformation in American politics: private sexual negotiations formerly dominated by men have become publicnegotiations with recourse to public standards of justice and fairness.2-0 out of 5 stars Sex is not as simple as Hirshman makes out
This book represents another step in the reduction of human affairs to legally arbitrated exchanges and misses the unique quality of sex.The very power of sex lies in its connection to a hoped-for reciprocity, aspontaneous and unstoppable expression of passion or love.Such anexpression cannot be compared to, for instance, the exchange between amerchant and client. In such an expression there is no buyer and seller, personal walls break down.Hirshman's humorless account of sex doesviolence to the emotional and spiritual experience of the act, missing, infact, that it is not an act at all, but an event.

5-0 out of 5 stars An historical perspective on the subject of sex and bargains
"Hard Bargains: The Politics of Sex" is an eminently readableand fascinating analysis of male/female sexual relationships from a newvantage point--bargaining theory.Whilethere is plenty of research andscholastic documentation covering both historical perspective and fresh anddaring contemporary isights, the book reads like a novel. The familiarparadigm of bargaining theory is surprisingly applied to the most personaland intimate of human relationships with logic and insight.Theresultsare rigorous and very provokingThis book traces the legal history ofwomen and sex from ancient times forward to the presentday. The middlechapters are fundamentally shockingas they show the pervasive extent ofmisogyny that legal scholars built into the very foundations of our Westernlegal system. With incredible quotations from the 'fathers' of our modernlegal system the reader gets to see the systemic bias -- bordering on evil-- that has colored legal thought to thisver;y day. The combination andintertwining of bargaining theory with a vast historical perspective leadsthe authors to some dramatic suggestions for legal change. The goal is to give men the legal tools to more adequately negotiatetheir most personallives from a more equally balanced bargaining position. This book ispowerful in scope and dramatic in its implications for today and thefuture.Every young person, andnot so young person, should read it. Their life and the law will never quite be the same! ... Read more

5-0 out of 5 stars Thorough yet disturbing discussion of 'justice'...
While there are probably very few people who think justice is truly blind to race, gender, class and sexual orientation, this look at the courts from Restoration until today is still shocking. The systemic protection of 'white male privilege' has made it impossible for just about anyone and everyone to get a fair trial. And throughout this book Berry argues convincingly, logically, simply and clearly why this has been the case.5-0 out of 5 stars An eloquent exposition.
The "Pig Farmer's Daughter" is a stalwart exposition describing the fault line of bigotry, and bias that runs through the historical bedrock of the American judicial system. Berry offers a seamless narrative, written eloquently and without malice. Her book is an irrefutable unveilingof the ignorance that so often poses as the truth of popular culture. Whatis so ironic is that the players she exposes were and are supposed to bethe very people who are without bias. Everyone and anyone who has a desireto understand racism and sexism in this country needs to read this book. Nolawyer or judge serious about racial justice should enter a courtroomwithout having read it. ... Read more
