This excellent study of nineteenth-century American households brings Hannah Arendt's assessment of the home as a place of labor and violence clearly into view.Amy Dru Stanley looks at the spread of contractarianism into household relations and finds not improvement but rather a different basis for wringing effort from subordinates to enrich and comfort their masters.Defenders of the south's peculiar institution used similar arguments with regard to labor, comparing the "wage slaves" in the north to the real slaves of the south, always in favor of the latter.Stanley's assessment is more nuanced, valuing individual freedom while remaining sensitive to the grinding hardships this freedom brought with it.The heart of her argument is her close analysis of the relations of dependency between slaves and masters and husbands and their wives and children.While the movement to free slaves had widespread support among many social groups, the movement to free wives, like today's movement to free children, was seen very differently.Indeed, slave emancipators held out the prospect to freedmen of being kings in their own castles, of holding their wives and children in bondage to themselves just as their white masters held their slaves and the members of their own families, to encourage them to leave their masters following emancipation.Yet for the freedmen, the money to be kings in their castles was lacking, and freedwomen had to labor as long and hard in freedom as they had in bondage to keep their poor households going.As a result, many resisted playing their assigned parts in the freedmen's family romance.Meanwhile, their poor white sisters faced similar economic constraints.Free labor during the era governed by the "iron law of wages" condemned workers' families to penury and, in extreme cases, pushed wives and daughters into prostitution as their only alternative to destitution.Stanley's informative discussion of the personal cost of commodification of labor to individuals and their families provides many opportunities to consider other results of this process on human existence. ... I was excited at the prospect of the author updating his earlier works, especially the "Badmen and Bloodletters" series. What I saw was a shock. To begin with, did anyone edit this before it was printed? There are pictures with incomplete captions, misspelled names, incorrect names. A lot of what appears was lifted directly from those earlier Nash books without any updates or editing. Thus, I was shocked to see the continued use of the offensive word "Negro" in Nash's narratives.

A number of aspects of this book make it very readable. Certainly, the four watershed cases, each presented with some detail and background, are good reading, and each highlights an important chapter in American history. The author' s critical opinions of the personalities and accomplishments of the Justices lend a sharp focus to each of the Courts. Then, the reasonable brevity of the book gives the reader a good opportunity to reflect over both the evolution of the Supreme Court and how it relates to the development of the United States as a whole.

I give five stars for three reasons. First, unlike many other legal histories it has few Latin phrases and most legal terms are explained. Second, the competition is multivolume tombs, most of which are very out dated, so this is by default the best book out there. Third, arguably, every major justice and case that shaped the philosophy of Constitutional Law is covered.It is remarkable that such long history can be meaningfully condensed into one book. It is an excellent reference to look up subjects that appear in books, news and current events. It is essential for understanding Constitutional Law.

Bernard Schwartz's "A History of the Supreme Court" is a readable if dry narrative of the 200 years of the Supreme Court between John Jay and William Rhenquist.The story of the supreme court is a complicated one, and for the most part, Schwartz tells it well.If his book is short on analysis and long on description, it is probably more due to the nature of the subject then to the qualities of the author.Read more

Few people know that while the infamous Salem witch hunt was taking place in 1692, southwestern Connecticut was undergoing a scare of its own. Godbeer has meticulously researched this event and presents a remarkably detailed story based upon the participants own words. He follows the accusers, the victims, the "witches", the ministers, and the magistrates, from the beginning of the outbreak to its much-more-sensible-than Salem conclusion. Robinson's Wild Beasts and Idle Humours (The Insanity Defense from Antiquity to the Present) sounds and looks more fun than it actually will be for the average reader without a sure grounding in legal, philosophical and psychological theory and history.The author does indeed cover the period from antiquity to the present, as per the sub-title, and provides many interesting ideas along the way, taking a rather conservative approach, but there are also many cases and people just dropped into the book without any explanation on the assumption that the reader will be familiar with all of these legal cases and philosophers from the past two centuries.A grounding in classical and medieval history (with luck I did have that) will help the reader manage the first part of the book.For students of legal history, this book could prove quite interesting and, perhaps, invaluable as the author makes a clever attempt to bring ideas of insanity as far back as the writings of Homer and Hesiod.For this poor soul, the book was a struggle with a few rewards along the way. ... Samuel Walker has created a wonderful book on the history of the ACLU, In Defense of American Liberties, that is a must for anyone concerned with the history of freedom of speech and the men and women who fought for them in America.This book shows the development from fringe to mainstream of the ideas shared by a group of people in the 1910's.The book is by no means hagiography as the darker moments of the ACLU are presented with clarity, such as their hounding and forcing out of Communist members simply for their beliefs.It is both very informative and truly entertaining.A wonderful book that demonstrates the importance the ACLU has had in the twentienth century shaping political ideas. ... Of all the commentators I trusted Dunne's insight because I believe it came from a person who knew Hollowood.While the book covers many other cases I believe he gave us more insight on O.J. and the kind of man he was.After reading his observations I have to wonder how Judge Ito allowed this circus to go on.

In this collection of 19 essays, which originally appeared in "Vanity Fair" magazine, Dominick Dunne presents nine true accounts of crimes, trails, and punishments, mostly delayed or denied.He begins with his own wretched first experience with the debacle of the American court system, in which his own daughter was violently murdered, and the guilty served a sentence of only 2 � years.Ten of the essays deal with the O.J. Simpson case.Dunne always believed O.J. was guilty of the double murders, and he presents what happened at the trail and sketches of the participants in a straightforward manner that would convince all but the most stubborn.One essay deals with the Menendez brothers trail for the murder of their parents, another case where the victims are victimized again.The other essays deal with lesser known, but no less sensational crimes.What comes out of these episodes is a realm of society that few of us know well:multi-divorces, extra-marital affairs, extravagant spending, high-flying life styles, cut throat business dealings.It is as fascinating to read, as it is repugnant.Dunne is an outsider who has gained admittance to the inner thoughts and dealings of this nether world and brings it to us unflinchingly.Highly recommended.

In this insightful and yeomanly researched book, Karen Donovan paints a vivid picture of a man who has achieved iconic status among America's trial lawyers. Thanks to the access granted the author by David Boies, we get not only a ringside seat for some of the last decade's most high-profile trials, including, of course, the one that put the current occupant of the White House in office, but we're there for pre-trial strategy sessions and post-trial dinners as well. Throughout, Donovan maintains a keen-eyed objectivity and isn't afraid to deflate balloons of bravado when need be. All in all, it's a compelling read.

Most of pieces of Boies border on idolatry. Donovan's work is special because although she clearly admires Boies and his work, she also points out his faults. The best reading in the book includes her digging behind the scenes to reveal what really happens in trials, settlements, and negotiations. Cushman's book is an outstanding history of the "switch-in-time."He effectively debunks the myth that the Hughes Court did a sudden reversal because of Roosevelt's landslide reelection or his Court-packing plan.Rather, the key decisions that many scholars attribute to Roosevelt pressure had actually occurred before his Court-packing plan became known.In addition, the Court did not fear political pressure because they had survived it before and the majority of Congress did not support Roosevelt's Court-packing plan anyway.After debunking this myth, Cushman goes on to explain the structure of the real revolution, which was the "demise of constitutional federalism" that began with the Nebbia decision in 1934 and flowered in the early 1940s, after Hughes and his old-school colleagues had left the Court.Cushman's book is excellent: his arguments are sound and his writing is eloquent.I recommend this book to anyone who wants to understand the real history of the Supreme Court during the 1930s. ...
