The Legacy of the Rehnquist Supreme Court is that not much has really happened, according to Mark Tushnet, Professor of Constitutional Law at Georgetown University Law Center.The Court has maintained the line on Abortion and Affirmative Action, expanded gay's rights in its famous Lawrence vs. Texas decision, and in the cause of Federalism, it made only slight moves (it did limit the power of the US Congress under the Commerce Clause, for the first time since the New Deal, but upheld most Federal Laws against "Federalist" assaults). 3-0 out of 5 stars Dry but academically appropriate
I read this book as to get a simple foundation/understanding of the U.S. Supreme Court and their historical trends covering the major issues talked about in society today. It is dry, typical book you would read before or during law school but would not recommend it for someone not interested in pursuing law.

Books for well-read non-lawyers interested in the "behind-the-scenes" Supreme Court and its relationship to the Court's jurisprudence have been around for quite some time.Bernard Schwartz, beginning in the early 1980s, published a series of books on the Warren, Burger and early Rehnquist Courts, usually focusing on unpublished memoranda and draft opinions circulated among the justices.Bob Woodward and Scott Armstrong published a best-selling account of the Supreme Court -- The Brethern -- in the late 1970s.This book was fascinating, albeit quite gossipy.Edward Lazarus, in Closed Chambers, tried the Woodward/Armstrong trick for the late Burger/early Rehnquist Courts, leavening gossip concerning mutual antipathies among the justices with more doctrinal analysis.

It is important to realize that this book is not really about the 2nd Amendment. Instead, Malcolm seeks to chart the development of the English conception of a right to keep and bear arms, which clearly has influence upon the 2nd Amendment. The history of the English right is fascinating. It began as an onerous duty that many Englishmen resented and Malcolm traces the development of the right during the violent 17th century during which many Englishmen were disarmed as a means to stem any armed opposition. The right was created in 1689 as a means of ensuring that an armed citizenry would always be available to oppose a standing army. 5-0 out of 5 stars Funk's Commentary in the Howard Law Journal

Ms. Malcolm nicely lays out the history of the tension between English rulers and subjects over the control of weapons.She made me realize that the current dispute in this country over access to firearms has a longpedigree.Her depiction of the circumstances under which England, in 1689,declared the right to bear arms "true, ancient, and indubitable,"when in fact it was none of those is particularly interesting.(See p.115.)She provides evidence for her view that "it is particularlyironic that some modern American lawyers have misread the English right tohave arms as merely a 'collective' right inextricably tied to the need fora militia" (p. 119) when by 1689 the opposite was true.I'm not ahistorian or a gun enthusiast, but I find all of this quitefascinating.Read more

For those of us who primarily hear about Supreme Court cases through the news or at school, it is easy to forget that the actual Court decision that emerges from a case is the complex interaction of nine individuals interpreting the law and the facts.This book explores in fascinating detail how the Supreme Court's landmark decisions are very much a human endeavor reflecting the different justices' world views.While Faigman uses the justices' understanding of science (or sometimes misunderstanding) in making their legal decisions as his primary prism to examine the Court, the book is anything but simply a "law and science" book.To me, it was much more about how the justices bring their individual strengths and weaknesses, their hopes and fears as human beings, to deciding cases with profound implications for society.I always had assumed, for example, that Justice Taney, who decided the infamous Dred Scott decision that saw slaves as property to be owned, must have been a bigoted villain.While Taney by no means emerges from Faigman's telling as a hero, he does become much more of a three-dimensional figure, one who had deep personal qualms about slavery but who, in a terribly misguided way, thought he was saving the Union by his opinion in Dred Scott.In chapter after chapter, Faigman similarly shows how Court decisions that we have all heard of, like Brown v. Board of Education, are much more than simply decisions reflecting "The Law," but reflect individual justices' struggles with changing scientific and social understandings. I don't know if the author meant the title "Laboratory of Justice" to have anothermeaning beyond looking at how the Court tries to adapt the law as science changes our understanding of the world around us, but as I read the book, I did find myself thinking of the justices not as the scientists running the "laboratory of justice" but as part of the experiment itself going on in the laboratory of justice. This is a superb book for anyone who wants to gain insight into the Court's workings as told by someone with a keen eye for interesting facts that are insightful and entertaining at the same time. ... "Arsenic Under the Elms" is thoroughly an intriguing, mind challenging read.I felt Virginia A. McConnell did a wonderful job presenting the known facts, as well as including her speculations, but leaving the final verdict up to the reader.The explanations of the era and how they dealt with these sorts of crimes, as well as how they dealt with it legally and medically were very educational and thought provoking.I'm sure many criminalists, physiologists, lawyers, judges, and crime scene analysts, would have a field day solving these crimes.If only they had the technology of today, back then.Even if your genre is not "true crime," this book is a great read.I recommend.

this was a great book! I loved the comparison of how the world & justice worked in the time setting of the 2 stories versus how we have it now. I am fasinated by the victorian era & true crime. This book blended both into a very ingrossing experience. I can't wait to read her 2nd book "Sympathy for the Devil:the Emmanuel Baptist Murders." and hope there will be more after that!

The author's enthusiasm for these compelling stories is apparent in herresearch and writing.She brings to life two still-shocking crimes with arefreshing lack of sensationalism.However, the writing itself rarelyrises above the level of a bright college sophomore's term paper.Inspots, the editing is poor, for example, the author will reference factsthat hadn't been presented yet by that point in the book.Too much attemptis made to judge by modern mores and motives, sometimes implicitly andsometimes explicitly (repeated comparisons to the OJ Simpson trial, forexample)...further research into social history of the time would haveimproved the book.It's often not entirely clear what facts are documented(or how) and what is speculation, even with reference to the copiousfootnotes.Worth a read, but look for it at the library. ...
